  • Used a dangerous weapon or other equivalent force known to cause injury or death

This crime is either a second degree or third degree felony, depending on the exact circumstances of the act. Should the aggravated assault be committed by a prisoner, it will be considered a first degree felony if serious injury occurred and a second degree felony is no injury was caused.
